Terms and conditions
Draft. The parts marked [[IN CAPITALS]] are filled in by the producer. The final text must be checked by an accountant or a lawyer before it is published.
Effective from [[EFFECTIVE DATE]]
1. The seller
- Name: [[owner_name]]
- Address: [[owner_address]]
- Primary producer registration number (FELIR ID): [[FELIR ID]]
- Tax number: [[TAX NUMBER]]
- Phone: [[phone]]
- Email: [[email]]
The hosting provider's details are in the Imprint.
2. Scope of these terms
These terms apply to every order placed in the [[shop_name]] webshop, whether it arrives through the website or through an AI assistant. By sending an order, the customer accepts these terms and the Privacy policy.
The language of the contract is Hungarian. The English and German versions are courtesy translations; if they differ, the Hungarian text applies. The contract is not a contract made in writing; the seller stores the order data electronically and the customer receives them in the confirmation email. The seller has not signed up to a code of conduct.
3. Products and prices
- The main features of the products (name, net quantity, ingredients, allergens, origin, storage) are shown on the product pages.
- Prices are gross final amounts in Hungarian forints. The unit price is shown next to every price.
- The cart shows the delivery fee separately before the order is sent.
- The price valid when the order is sent applies to the order. If a price is obviously wrong (for example 0 Ft), the seller does not have to hand over the product at that price; the seller offers it at the correct price and the customer may withdraw from the order.
- Product photos are illustrations. The colour and texture of honey vary naturally from batch to batch, and crystallisation is a natural property of honey.
4. How to order on the website
- The customer puts the chosen products in the cart. Quantities can be changed and items removed in the cart.
- On the cart page the customer enters their name, email address and phone number, chooses how to receive and pay for the order, and gives the delivery address if they chose delivery.
- The page shows the subtotal, the delivery fee and the total to pay.
- The details can be corrected at any time until the order is sent.
- The customer accepts these terms and the Privacy policy, then sends the order with the "Place order (with an obligation to pay)" button. The order carries an obligation to pay.
No registration is needed to buy. The minimum order value is [[min_order]].
5. Ordering through an AI assistant
The products can also be ordered through an AI assistant (for example ChatGPT, Gemini or Claude). In that case the order is made in three steps:
- Order request: the assistant sends the order details on the customer's behalf. This is not yet an order and creates no obligation. The prices and the total are always calculated by the webshop, not by the assistant.
- Confirmation by email: the seller sends an email to the given address with the order summary and a "Confirm the order (with an obligation to pay)" button. The customer places the order personally by clicking this button, and by doing so accepts these terms and the Privacy policy. The confirmation link is valid for 24 hours and can be used only once.
- Contract: after the confirmation, the order continues exactly like an order placed on the website (section 6).
A request that is not confirmed within 24 hours expires automatically and creates no obligation for the customer. The assistant's provider does not act for the seller; the seller is not responsible for information given by the assistant, and the details in the webshop and in the confirmation email always apply.
6. How the contract is formed
Sending the order (or confirming it, for an AI assistant order) is the customer's offer. The seller acknowledges receipt of the order by an automatic email without delay, within 48 hours at the latest. If this acknowledgement does not arrive within 48 hours, the customer is no longer bound by the offer.
The contract is formed when the seller confirms the order separately or hands over the product. If the seller cannot fulfil the order because the product is out of stock or for another reason, the seller tells the customer without delay and refunds any amount already paid within 14 days at the latest.
7. Payment methods
- Bank transfer in advance: to the bank account given in the confirmation email, with the order number as the payment reference. The seller hands over or delivers the product after the amount has arrived. If the amount does not arrive within [[PAYMENT DEADLINE]] days, the seller may cancel the order.
- Cash on delivery: in cash when the order is delivered; available for local delivery only.
- Cash at pickup: for personal pickup, at the pickup address.
The seller issues a receipt or an invoice for the purchase as required by the rules that apply to the seller.
8. Pickup and delivery
- Personal pickup: [[pickup_address]], at these times: [[pickup_hours]]. Pickup is free.
- Local delivery: the seller delivers in person to these postal codes: [[delivery_zip_codes]]. Delivery days: [[delivery_days]]. The delivery fee is [[delivery_fee]]; delivery is free for orders over [[free_delivery_over]].
- The seller agrees the time of delivery or pickup with the customer by phone or email. Unless agreed otherwise, the order is fulfilled within 30 days of the contract being formed.
- The seller does not deliver to other addresses, other towns or abroad, whatever the language of the website.
- The customer checks at handover that the package is intact; damage is best reported at once.
9. Right of withdrawal
A customer who is a consumer may withdraw from the contract within 14 days of receiving the product, without giving a reason (Hungarian Government Decree 45/2014. (II. 26.)). The right can also be used between the conclusion of the contract and the receipt of the product.
- The withdrawal must be made by a clear statement to the seller (by email or by post, using the contact details in section 1); the form in section 10 can be used. The deadline is met if the customer sends the statement on the 14th day.
- The customer must hand back or send back the product within 14 days of the withdrawal. The customer bears the direct cost of returning it.
- The seller refunds the full amount paid, including the delivery fee, within 14 days of receiving the withdrawal, using the same payment method the customer used, unless the customer expressly agrees to another one. The seller may withhold the refund until the product has been returned or the customer has proved that it was sent back.
- The customer is liable for any loss in the product's value caused by handling it more than is needed to establish its nature and characteristics.
The customer has no right of withdrawal for:
- sealed products that cannot be returned for health or hygiene reasons once they have been unsealed after delivery (for example an opened jar of honey or bottle of propolis);
- products that are perishable or keep their quality only for a short time;
- products put together or labelled to the customer's individual request (for example a custom gift pack).
10. Model withdrawal form
Fill in and return this form only if you wish to withdraw from the contract.
To: [[owner_name]], [[owner_address]], [[email]]
I hereby give notice that I withdraw from my contract of sale of the following product(s):
Order number, product(s): …
Ordered on / received on: …
Name of the customer: …
Address of the customer: …
Date: …
Signature of the customer (only if this form is sent on paper): …
11. Faulty products: statutory warranty and product warranty
- Statutory warranty (kellékszavatosság): if the product was faulty when it was handed over, the customer may, under the Hungarian Civil Code, first ask for a replacement or a repair; if this is not possible or the seller does not do it, the customer may ask for a price reduction or withdraw from the contract. The fault must be reported without delay after it is discovered, within two months at the latest. A consumer can make the claim within two years of the handover. A fault noticed within one year of the handover is presumed to have existed at the handover, unless this is incompatible with the nature of the product or of the fault.
- Product warranty (termékszavatosság): if the product is faulty, the customer may ask the manufacturer (here the seller) to replace or repair it within two years of it being placed on the market. The two claims cannot be made at the same time for the same fault.
- The seller gives no commercial guarantee for the products, and no mandatory guarantee applies to them.
- The crystallisation of honey and any loss of quality caused by incorrect storage are not faults.
12. Complaints and legal remedies
The customer can make a complaint using the contact details in section 1. The seller looks into a spoken complaint at once and resolves it if possible; a written complaint is answered in writing within 30 days, with reasons if it is rejected. The seller keeps the record of the complaint and a copy of the answer for three years.
If the complaint is not resolved, the consumer can turn to:
- Conciliation board (békéltető testület): the county conciliation board of the consumer's place of residence or stay, or the board of the seller's seat: [[NAME, ADDRESS AND EMAIL OF THE CONCILIATION BOARD]]. The procedure is free and the seller must cooperate in it. The boards are listed at bekeltetes.hu.
- Consumer protection authority: the county government office of the consumer's place of residence (kormanyhivatalok.hu).
- Court: the customer may also take the claim to court under the rules of civil procedure.
13. Customer account
A customer account is optional. Customers log in without a password, with a one-time code sent to their email address; the account is created at the first successful login. The account shows earlier orders and can store the details used for ordering. The account can be deleted at any time; deleting it does not affect orders already placed. The account does not change prices or the terms of an order.
14. Other provisions
- The seller may change these terms; a change applies to orders placed after it is published. An order already placed is governed by the terms in force when it was placed.
- Matters not covered here are governed by Hungarian law, in particular Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services, Act CLV of 1997 on consumer protection and Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses.
